Tender allows unlicensed entities, ignoring OGRA licence requirement

Stakeholders have raised questions over the bidding process initiated by a petroleum company for the sale of 35% gas from the Spinwam Gas Field, citing concerns about compliance with the Council of Common Interests (CCI) decision. the Petroleum Division's SRO 11(I)/2025.

The petroleum ministry has been approached regarding compliance with rules on third-party gas sales. The company's advertisement appeared to be in clear violation of requirements laid down by the Oil. Gas Regulatory Authority (OGRA). A formal complaint has been lodged with senior government authorities. alleging that the tender conditions do not incorporate the mandatory requirement of a valid OGRA licence for participation.

According to sources, the CCI-approved framework. the subsequent notification permit gas sales to third parties only through a competitive process involving entities possessing valid OGRA licences. However, the tender reportedly allows participation by entities registered with tax authorities without expressly requiring such licensing.

Any departure from the licensing requirement could undermine the regulatory framework and expose the process to legal challenges. Allowing unlicensed entities would be inconsistent with the applicable policy framework.

The matter has been brought to the attention of the prime minister, the energy ministry, OGRA. other relevant authorities, seeking an immediate review.

The bidding process has created serious concerns among entities already holding valid OGRA licences. who believe the tender conditions place compliant, licensed participants at a disadvantage. If the alleged discrimination is not rectified, affected parties may approach the superior courts seeking cancellation of the tender.

Since the last date for submission of bids is June 15, 2026, sources urged the authorities to immediately withdraw the existing notice. issue a fresh one in conformity with the CCI decision.
